Consent is never required to obtain financing. You are not required to agree to receive marketing calls or texts as a condition of purchasing any goods or services, or of receiving financing. You can withdraw your consent at any time, by any reasonable means — see section 8.

1. The consent disclosure in full

This is the language presented at the point of submission on our application forms. Submitting a form means you agree to it.

By clicking the submit button, I provide my electronic signature and express written consent, and I agree to the Terms of Use, Privacy Policy and these Consent and Communication Terms.

I authorise BidMyCapital and the participating financing providers it selects — no more than 50 for this submission — to contact me at the telephone number and email address I supplied, including on a mobile number, for marketing and for servicing my financing request. I agree they may contact me by telephone call, text (SMS/MMS), prerecorded or artificial voice message, and email, including through an automatic telephone dialling system or other automated technology.

I understand that consent is not a condition of purchasing any goods or services and is not required to obtain financing. Message and data rates may apply. Message frequency varies. I can reply STOP to any text to stop texts, or revoke consent at any time by any reasonable method, including those listed at bidmycapital.com/opt-out.

I confirm that I am at least 18 years old, that the telephone number I supplied is my own or one I am authorised to provide, and that I am seeking financing for business purposes.

2. Electronic signature

Under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state Uniform Electronic Transactions Acts, clicking "Submit", "Continue", "Get My Offers", "I Agree" or a similar button, or checking a consent box, constitutes your electronic signature. It carries the same legal weight as a signature written by hand on paper.

We retain a record of each consent, including the date and time, the IP address, the page URL, the form fields submitted, and the exact disclosure text displayed to you at that moment. We keep these records for at least five years. You may request a copy of your own consent record at any time through Your Privacy Choices.

3. Permission to share your information

By submitting a financing request you authorise us to transmit the information you provided — your name, business name, telephone number, email address, and the business and financial details on the form — to independent financing providers so they can evaluate your request and contact you about it.

4. Calls, texts, prerecorded messages and email

Calls may be monitored or recorded for quality, training and compliance. Where the law of your state requires the consent of all parties to a recording, you will be told at the start of the call and may object.

Message frequency varies based on your activity and the stage of your request. Message and data rates may apply under your plan with your mobile carrier. We do not charge you for messages.

5. Automated technology and prerecorded voices

You expressly consent to being contacted using an automatic telephone dialling system (ATDS), a predictive or preview dialler, an automated text platform, an artificial or prerecorded voice, and any comparable technology, at the telephone number you supplied — including a wireless or mobile number, and including where you are charged for the call or message.

This consent is given knowingly and voluntarily, and is separate from any agreement to purchase. It is the "prior express written consent" required by the federal Telephone Consumer Protection Act (TCPA) and its implementing regulations.

Your consent to receive autodialled or prerecorded marketing calls and texts is not a condition of purchasing any goods or services, and is not required in order to obtain financing.

8. How to revoke consent

You may revoke your consent at any time, for any or all channels. You do not have to use any particular method or wording. Any reasonable method works, including:

Timing. We honour a revocation made by any reasonable means and will action it as soon as practicable and in any event within 10 business days of receipt, consistent with the FCC's revocation rules. STOP replies to texts are processed automatically and immediately.

What revocation does and does not do. Revoking with us stops our calls, texts and emails, and stops us sharing your information with additional providers. It cannot recall information already transmitted, and it does not stop providers who already received your request from contacting you — you must revoke with each of them directly. We will tell you which providers received your submission if you ask.

Transactional messages. After you opt out of marketing we may still send you messages you specifically request, and messages we are legally required to send.

The providers we transmit your request to will contact you directly and independently, using their own systems, their own scripts and their own schedules. BidMyCapital does not control the timing, frequency, content or channel of their communications.

11. Financing-information requests

You may ask us for information about financing without consenting to marketing calls or texts. Email legal@bidmycapital.com or call (814) 637-3076 and say that you want information only. We will respond by your preferred channel and will not enrol you in marketing or share your details with providers unless you separately ask us to.

Nothing we send in response is an offer of credit, a pre-approval or a commitment to lend. See Terms of Use, section 3.

12. State-specific telephone and texting notices

Several states impose requirements stricter than federal law. Where you live in one of these states, the stricter rule applies to you and overrides anything more permissive elsewhere in this page.

Florida

Under the Florida Telephone Solicitation Act, we obtain your prior express written consent before making any telephonic sales call to a Florida number using an automated system for the selection or dialling of telephone numbers, or a prerecorded or artificial voice. Florida limits solicitation calls to 8:00 a.m. to 8:00 p.m. local time and restricts the number of commercial solicitation calls to the same person on the same subject to no more than three in a 24-hour period.

Oklahoma

Under the Oklahoma Telephone Solicitation Act, telephone solicitations to Oklahoma numbers are restricted to 8:00 a.m. to 8:00 p.m. local time, prior express written consent is required for automated and prerecorded solicitation calls, and the number of commercial solicitation calls on the same subject is limited to no more than three in a 24-hour period.

Washington

Under Washington's Commercial Electronic Mail Act and telephone solicitation statutes, commercial solicitation calls to Washington numbers are restricted to 8:00 a.m. to 8:00 p.m. local time. Callers must identify themselves and the company at the start of the call, state the purpose of the call, and end the call within 10 seconds if you say you are not interested. Washington also restricts commercial text messages sent to a Washington number without consent.

Other states

How we enforce this. These are not statements of intent only. Our dialling and messaging systems determine the recipient's state and local time from the telephone number and the address supplied, and enforce the applicable calling-hour window, frequency cap, consent requirement and suppression list automatically before a call or message is placed. Suppression and revocation records are applied across all channels and retained indefinitely.
